Public Comment Period Open Until July 17
The Wisconsin Department of Natural Resources (DNR) has published a draft economic impact analysis (EIA) for the proposed rule revisions relating to non-landfill solid waste management under chs. NR 157, 500, 502, 518, 520 and 526, Wis. Adm. Code. The DNR is holding a public comment period to solicit information on the analysis and all economic effects of the proposed rule revisions.
The proposed rule makes updates to code that affects non-landfill solid waste facilities, including infectious waste and PCB waste facilities. Non-landfill facilities manage waste before it goes to a landfill (transport or transfer of all solid waste or treatment of infectious waste) or in place of going to a landfill (combustion, composting, processing for recycling, landspreading for agricultural benefit, using it as fill material or other beneficial reuse). This proposed rule regulates facilities and activities that require solid waste approvals and licenses. It also regulates facilities and activities that are exempt from licensing, approval requirements and some operating requirements.
The DNR is proposing this rule to adapt to changes in industry technology, waste materials, landfill reduction goals and the focus on management of materials separated from municipal solid waste. The rule also streamlines and clarifies parts of the code that stakeholders have found confusing since the last rule revision 20 years ago.
Materials for review will be available beginning June 17 on the DNR’s Proposed Permanent Administrative Rules webpage under Natural Resources Board Order Number WA-14-24. The DNR will accept comments on the draft EIA from June 17 to July 17, 2026. Please direct any comments on the EIA or questions to Casey.Krausensky@wisconsin.gov, 608-577-3643.
